INFORMATIVA PRIVACY

In accordance with the provisions of EU Regulation No 679/2016 (hereinafter referred to as the Regulation), Article 13 - Information to be provided in the case of the collection of personal data from the data subject - GAJA DISTRIBUTION GIORDANO Lucia & C S.A.S., with its registered office at via Torino N.18, 12050 Barbaresco (CN), (hereinafter referred to as the Company), provides the following information about the processing of personal data of its clients (hereinafter referred to as “Data”) by the Company as the Data Controller.

Pursuant to Article 4 of the Regulation, the Company is the data controller of the data relating to its customers.

Categories and types of Data collected and processed

The Data processed by the Company includes personal data, which are not part of particular categories (art. 9 of the Regulation) collected for the purpose of concluding the contract and in the context of the execution and/or conclusion thereof.

Moreover, it is possible to obtain a processing of personal data of third parties communicated by customers. With regard to this hypothesis, customers are autonomous data controllers and assume the consequent legal obligations and responsibilities, holding back the Company from any dispute, claim and/or claim for compensation for the damage caused by processing received by the Company from interested third parties.

 

Specifically, we collect the following information:

  • Information you provide to us when you use our Services, including your contact information, your logins and passwords used to access the Services, activity and performance information, information on the measures taken so that we can recommend the best product for you, and credit card information.
  • Information about the computers and devices you use to access our Services, including their location.
 

The purpose and legal basis of processing and nature of data provision

In accordance with applicable data protection laws and without the need for explicit consent of the data subject, the Data will be stored, collected and processed by the Company for the following purposes:

(a) the fulfilment of contractual obligations, the performance and/or conclusion of a contract and/or the management of any pre-contractual measures;

(b) compliance with any legal, tax and tax obligations arising out of the conduct of business and obligations relating to administrative and accounting activities;

Providing the data for the aforementioned purposes is optional, but any failure to provide the data and refusal to provide them would prevent the Company from performing and/or concluding the contract and providing the services required by it.

The legal basis for the processing of personal data for the purposes of c) and d) is Article 6.1.a) of the Regulation, because the processing is based on consent; we inform you that the Controller may obtain one consent for the marketing purposes described here, in accordance with the general provision of the Guarantor for the protection of personal data "Guidelines on promotional activities and combating spam" of 4th July 2013.

Consent to the use of data for the marketing purposes is optional and if the data subject wishes to object to the processing of data for the marketing purposes carried out in the manner indicated here, as well as to revoke the consent granted, he may do so at any time without any consequences (except that it will not receive any more marketing information) by following the instructions in the section “Rights of the data subject” of this Policy.

 

 

Methods of data processing

For the purposes indicated, the processing of data shall be carried out by means of manual, IT and telematic tools with a logic closely linked to the objectives themselves and, in any case, methods guaranteeing the security and confidentiality of the data, in addition to compliance with specific obligations laid down in the legislation. The data will be processed in accordance with the principle of legality, correctness, accuracy and non-excess, in accordance with the provisions of the law on the protection of personal data. The processing will be carried out by formally appointed and properly trained personnel.

 

The scope of communication and dissemination of data, recipients and transmission of data and data processors

For this purpose, the Data may be transferred to other companies of the Group and to third parties designated as data processors pursuant to Article 28 of the Regulation, in particular banks, insurance companies, service providers strictly necessary for conducting business activity, or consultants of the company, if this proves necessary due to tax, administrative requirements, contractual or regulatory.

In addition, other companies of the Group may access the data for administrative and/or accounting purposes, in accordance with Article 6 and paragraphs 47 and 48 of the Regulations.

Finally, the Data may be made available to authorities, authorities and/or entities to which the Data must be transferred in accordance with the law or the order of the authority. These authorities, entities and/or entities will act as independent data controllers.

The data will not be distributed.

A periodically updated and complete list of data processors designated for data processing may be required by sending an e-mail to the data controller to the aforementioned addresses.

 

The transfer of Data to international organisations and/or non-EEA countries (European Economic Area)

Any transfer of Data to international organisations and/or non-EEA countries will take place in one of the ways permitted by the current legislation, such as the consent of the data subject, the adoption of Standard Clauses approved by the European Commission, the selection of subjects belonging to international programs for the free movement of data (e.g. EU-USA Privacy Shield) or operating in countries considered safe by the European Commission.

 

Data storage

We store your data for as long as you have an account with us or are an active client of the Company.

The data will be stored in paper and/or computer form only for the time necessary for the purposes for which they were collected, respecting the rules on storage and minimization referred to in Article 5(1)(c) and (e) of the Regulation.

The data will be stored in order to comply with regulatory obligations and achieve the aforementioned objectives, in accordance with the principles of necessity, non-exclusion and relevance.

We will store information from deleted accounts to comply with law, prevent fraud, collect expenses, resolve disputes, resolve issues, Assistance in investigations, warranty claims processing, distribution of important product information (in the form of withdrawal from the market), enforcement of our contracts and other actions permitted by law; then, if the above reasons for processing are not met, the Data will be deleted, destroyed or simply stored anonymously.

The rights of the data subject

In connection with the aforementioned processing, any data subject may exercise the rights referred to in Articles 15 to 22 of the Regulation.

In particular, the data subject has the right to request access to his or her data, rectification or cancellation, the right to object to the processing or to request a restriction of processing in the cases provided for in Article 18 of the Regulation and to obtain in a structured manner, the commonly used and machine-readable format of your Data, in the cases provided for in Article 20 of the Rules of procedure.

The data subject may also revoke the consent granted pursuant to Article 7 of the Regulation at any time and lodge a complaint with the data protection authority pursuant

to Article 77 of the Regulation if he or she considers that the processing of his or her data is contrary to the applicable legislation.

In the event of objection to the processing of data pursuant to Article 21 of the Regulation, the Company reserves the right to assess a request that will not be accepted if there are compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject.
